Terms of Service

These Terms of Service (“Terms”) govern your use of the Taika mobile application (“App”) operated by Taika (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The App is intended for use by parents, guardians, and authorized caregivers.

2. Account Registration

You must create an account using Apple Sign-In or Google Sign-In to access the App. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

3. Description of Service

Taika is a baby tracking application that helps parents and caregivers log daily activities including sleep, feeding, diaper changes, growth measurements, pumping, temperature, medication, and routines. The App includes:

  • Activity logging with timers and manual entry
  • Real-time data synchronization across devices and caregivers
  • Home screen widgets for quick access
  • Push notifications for reminders and alerts

Premium features (requiring a paid subscription) include:

  • DreamTime — Sleep predictions based on your baby’s logged patterns
  • Ask AI — AI-powered assistant providing personalized answers using your baby’s data
  • Weekly Insights — Age-appropriate developmental guidance with personalized statistics
  • Development Activities — Expert-curated activities and milestone tracking

4. Subscriptions and Payments

Premium features require a paid subscription. We offer the following plans:

  • Monthly — Billed monthly, cancel anytime
  • Yearly — Billed annually, includes a 7-day free trial for eligible users
  • Lifetime — One-time purchase, no recurring charges

Subscriptions are processed through the Apple App Store or Google Play Store. Payment is charged to your App Store or Play Store account. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device’s subscription settings.

Free trials automatically convert to a paid subscription unless canceled before the trial period ends. Refund requests are handled by Apple or Google in accordance with their respective refund policies.

5. Caregiver Sharing

You may invite other caregivers to access a baby profile by sharing an invite code or QR code. By inviting a caregiver, you authorize them to view and edit all data associated with that baby, including activity logs, photos, and profile information. Up to 8 caregivers may be linked to a single baby profile.

You are responsible for managing who has access to your baby’s data. We are not responsible for actions taken by caregivers you have invited.

6. User Content

You retain ownership of all data you enter into the App, including activity logs, notes, photos, and baby profile information (“User Content”). By using the App, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely to provide and improve the App’s services, including delivering AI-powered features.

You represent that you have the right to submit any content you provide, including photos, and that your content does not violate any third-party rights.

7. AI Features Disclaimer

The Ask AI feature provides informational responses generated by artificial intelligence based on your baby’s logged data and general knowledge. AI responses are:

  • Not medical advice. AI responses are informational only and should never replace consultation with a qualified pediatrician or healthcare provider
  • Not guaranteed to be accurate. AI may produce incorrect, incomplete, or outdated information
  • Not a substitute for professional judgment. Always seek professional medical attention for health concerns about your child

We disclaim all liability for decisions made based on AI-generated content. In an emergency, call your local emergency number immediately.

8. Medical Disclaimer

Taika is not a medical device, diagnostic tool, or healthcare provider. All features — including sleep predictions (DreamTime), weekly insights, growth percentiles, and activity summaries — are informational tools to help you observe patterns. They are not diagnoses, prescriptions, or medical recommendations.

You should always consult your pediatrician or healthcare provider for medical advice regarding your child’s health, development, feeding, sleep, or any concerns.

9. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of these Terms
  • Attempt to access another user’s account or data without authorization
  • Reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App’s servers or infrastructure
  • Use the App to transmit malicious code or harmful content
  • Upload content that is illegal, abusive, or violates third-party rights

10. Intellectual Property

The App, including its design, code, features, branding, and content (excluding User Content), is owned by Taika and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our written permission.

11. Availability and Modifications

We strive to keep the App available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any feature or the entire App at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the App.

12. Limitation of Liability

To the maximum extent permitted by law, Taika and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

  • Reliance on AI-generated content or sleep predictions
  • Data loss or synchronization failures
  • Unauthorized access to your account
  • Actions taken by invited caregivers
  • Service interruptions or technical failures

Our total liability for any claim arising from or related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Taika from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Termination

You may stop using the App and delete your account at any time from within the App settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive (including liability limitations, indemnification, and dispute resolution) will survive termination.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in a class action. This does not limit your right to seek injunctive relief in court.

16. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the App.
